EKO AI Model License Terms and Privacy Policy

Preface

EcoStrategy Co., Ltd. (hereinafter referred to as “the Company”) has developed and established the “EKO AI Model” and related application services (collectively referred to as the “EKO Model”). By obtaining or using the EKO Model and its materials, you acknowledge that you have read, understood, and agreed to be bound by all the provisions of these License Terms and Privacy Policy. If you do not agree, you must immediately cease using the EKO Model.

  1. Definitions
  • License Grant: Refers to the permission granted by the Company, under the conditions of these Terms, for you to use, reproduce, modify, distribute, or otherwise exploit the EKO Model.
  • Licensor: Refers to the legal entity holding ownership and intellectual property rights of the EKO Model, namely the Company.
  • You (or Your): Refers to the licensee under these Terms, including any individual or legal entity who obtains or uses the EKO Model in any domain.
  • Third Party: Any individual or legal entity other than the Licensor or You.
  • EKO Model: The AI system developed by the Company, integrating generative AI, carbon credit management, ESG strategy, and business model analysis, including source code, training parameters, drivers, and related materials.
  • Derivative Model: Any model developed by modifying, adapting, migrating, or utilizing the outputs or data generated by the EKO Model.
  • Personal Data: Any information that can directly or indirectly identify a natural person, including storage, transfer, processing, deletion, or other means as defined by applicable laws.
  1. License Grant and Usage Restrictions
  1. Subject to these Terms, the Company grants you a non-exclusive, worldwide, non-transferable, non-sublicensable, royalty-free license.
  2. You shall not use the EKO Model or any Derivative Model for:
    • Any military, unlawful, or improper purposes;
    • Activities violating ESG principles, including but not limited to greenwashing, falsification of carbon credits, or misleading sustainability disclosures;
    • Infringing upon intellectual property rights, portrait rights, privacy rights, or other lawful interests of third parties;
    • Violating applicable laws or international regulations, including but not limited to GDPR, Taiwan’s Personal Data Protection Act, the EU Artificial Intelligence Act, or carbon trading regulations.
  3. You may add your own intellectual property notices to Derivative Models, provided that such notices do not conflict with these Terms.
  4. Derivative Models must clearly indicate that they are based on the EKO Model.
  5. Unless expressly authorized in writing, you may not claim to be an agent, partner, or representative of the Company.

III. Intellectual Property Rights

  1. You may hold intellectual property rights to Derivative Models developed lawfully, provided that this does not affect the Company’s existing rights to the original EKO Model.
  2. Any legal disputes arising from your use or modification of the EKO Model (including but not limited to plagiarism, defamation, or infringement) shall be your sole responsibility. The Company reserves the right to seek compensation if damages occur.
  1. Trademarks and Identifiers
  1. Except for fair use, you may not use the Company’s trademarks, including but not limited to “EKO AI” or “EcoStrategy.”
  2. Without prior written consent, you may not register or use any trademarks identical or similar to the Company’s identifiers.
  1. Privacy and Data Protection Policy
  1. Scope of Data Collection
    • User registration, event sign-up, and survey responses.
    • Records and interaction data generated while using EKO AI tools.
    • Image, voice, and emotional data collected via micro-expression analysis or interview systems.
  2. Purpose of Data Use
    • ESG and carbon credit analysis, business model diagnostics.
    • Improving model accuracy and user experience.
    • Providing customer support, technical services, and statistical reporting.
  3. Data Retention and Security
    • All data will be encrypted and access restricted to authorized personnel.
    • Cross-border data transfers comply with GDPR, Taiwan PDPA, and other applicable regulations.
    • Data will be retained only for as long as necessary to fulfill legal or business purposes, after which it will be securely deleted or anonymized.
  4. User Rights
    In accordance with applicable laws, you may request to:

    • Access, review, correct, or delete your personal data;
    • Request cessation of data collection or processing.
      Requests should be submitted to the Company’s designated contact email.
  5. Third-Party Sharing
    • The Company will not sell or transfer your personal data without your consent.
    • If sharing is required for carbon credit transactions, research collaborations, or ESG projects, prior notice and consent will be obtained.
  6. Risks and Disclaimers
    • You acknowledge that AI models may contain algorithmic bias, and the Company does not guarantee absolute accuracy.
    • The Company bears no responsibility for damages caused by your erroneous inputs, misuse, or third-party abuse of the EKO Model.
  1. Disclaimer and Limitation of Liability
  1. The EKO Model is provided “as is,” without any express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
  2. You are solely responsible for ensuring compliance with laws and regulations when using the EKO Model for carbon trading, ESG reporting, or other applications.
  3. The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use of the EKO Model.
  4. If you violate these Terms and cause damages, you shall fully indemnify the Company.

VII. Collaboration Framework

The Company provides the following support to qualified partners:

  • AI Sustainability Strategy Modules: Carbon ROI forecasting and SDG indicator quantification.
  • Emotion Analysis System: Integration of micro-expression recognition with Likert scale for stakeholder analysis.
  • Global Carbon Asset Platform API: Supporting fair bidding, tracking, and verification of carbon credits.
  • Technical Support and Training: Assisting with implementation, optimization, and compliance.

Partner requirements include:

  • Availability of ESG/carbon-related datasets;
  • Adequate data processing and computing resources;
  • Proposals aligned with sustainability goals.

VIII. Term and Termination

If you breach these Terms, the Company reserves the right to immediately terminate the license and require deletion of all related EKO Model content.

  1. Miscellaneous
  1. These Terms and Policy will be published on the Company’s official website and may be revised at any time. Continued use after revisions indicates acceptance of the modified Terms.
  2. Governing Law and Jurisdiction: These Terms shall be governed by the laws of the Republic of China (Taiwan), with the Intellectual Property and Commercial Court as the court of jurisdiction.
  3. In case of discrepancies between the Chinese and English versions, the Chinese version shall prevail.
